THE SOFTWARE AND PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.3 Physical Interaction Disclaimer

Slap2Actions detects physical impacts on your MacBook. We are not responsible for any damage to your device resulting from physical interactions intended to trigger the app. Use common sense when interacting with your hardware.

7.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, zzStudio SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM OR SOFTWARE.

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless zzStudio and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of the Platform or Software
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any damage to your device caused by physical interaction with the Software

9. TERMINATION

We may suspend or terminate your access to the Platform at our sole discretion, including for violation of these Terms, fraudulent or illegal activities, or technical or security reasons. Upon termination, your right to use the Platform and Software will cease immediately.

10. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time and at our sole discretion. We will notify users of material changes by posting a notice on our Platform and updating the "Last Updated" date. Your continued use of the Platform after any modifications constitutes acceptance of the updated Terms.

11. GENERAL PROVISIONS

These Terms, together with our Privacy Policy, constitute the entire agreement between you and zzStudio regarding your use of the Platform and Software. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
